By accessing or using the Fortify Canada website (fortifycanada.ca) and any related services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree to these terms, you must not use our website or services.

These Terms of Service apply to all visitors, users, and others who access or use the site, including those who enroll in a Fortify Protection Plan, request service quotes, or browse informational content.

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to this page with an updated effective date. Your continued use of the site after changes constitutes acceptance of the revised terms.

Fortify Canada provides HVAC protection plans, maintenance services, repair services, and equipment installation to residential homeowners in Ontario, Canada. Our services are described in detail on individual service pages and within the Protection Plan Agreement.

All service descriptions, pricing, and availability information on our website are subject to change without notice. We make reasonable efforts to ensure accuracy but do not warrant that all information is complete, current, or error-free.

The website also provides informational content about HVAC systems, maintenance tips, energy efficiency, and Ontario-specific rebates. This content is for general educational purposes and does not constitute professional advice.

To enroll in a Fortify Protection Plan, you must provide accurate, complete, and current information during the enrollment process. You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account.

You must be at least 18 years of age and a legal resident of Ontario to enroll in a Protection Plan. By enrolling, you represent and warrant that you meet these eligibility requirements and that all information provided is truthful and accurate.

Fortify reserves the right to suspend or terminate your account and access to services if we determine that you have provided false information, violated these terms, or engaged in fraudulent activity.

Protection Plan fees are billed in advance according to your selected billing cycle (monthly or annual). All fees are quoted in Canadian dollars and are subject to applicable Harmonized Sales Tax (HST) at the rate of 13%.

By providing payment information, you authorize Fortify to charge your designated payment method for all applicable fees, including recurring subscription charges, one-time service fees, and any administrative charges for failed payments.

Failed or returned payments may result in suspension of Plan benefits. An administrative fee of up to $45.00 may be applied for each dishonoured payment. Fortify will attempt one retry within 5 business days before suspending services.

Price adjustments may occur with a minimum of 30 days' written notice. Continued enrollment after the effective date of a price change constitutes acceptance of the new pricing.

You may cancel your Protection Plan at any time by providing written notice via email to info@fortifycanada.com or by calling (855) 540-0007. Cancellation takes effect at the end of the then-current billing cycle.

Under the Consumer Protection Act, 2002 (Ontario), you have a 10-day cooling-off period from the date of enrollment during which you may cancel for a full refund, provided no services have been rendered.

If services were rendered during the cancellation period, Fortify may retain the fair market value of those services. No refund will be issued for partial billing periods after the cooling-off period.

Fortify may terminate your Plan immediately for cause, including nonpayment, fraud, abusive behaviour toward staff, or material breach of the Protection Plan Agreement. No refund is issued for termination for cause.

All content on the Fortify Canada website, including text, graphics, logos, images, service descriptions, and software, is the property of Fortify Home Services Inc. or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from our website without prior written consent from Fortify Canada.

The Fortify Canada name, logo, and all related marks are trademarks of Fortify Home Services Inc. Unauthorized use of these marks is strictly prohibited.

You agree not to use the Fortify Canada website for any unlawful purpose or in any way that could damage, disable, overburden, or impair the site. Prohibited activities include attempting to gain unauthorized access to our systems, interfering with other users' access, or transmitting malicious software.

You may not use automated systems, such as robots, spiders, or scrapers, to access the website for any purpose without our express written permission.

Any feedback, suggestions, or ideas you submit to Fortify Canada regarding our services may be used by us without restriction or compensation to you.

The Fortify Canada website and all content, services, and products available through it are provided on an 'as is' and 'as available' basis without warranties of any kind, either express or implied.

Fortify does not warrant that the website will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. We do not make any warranty regarding the results that may be obtained from using the site or the accuracy or reliability of any information obtained through the site.

Your use of the website and any information or materials downloaded from it is at your own discretion and risk. You are solely responsible for any damage to your computer system or loss of data resulting from such use.

To the maximum extent permitted by applicable law, Fortify Home Services Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or relating to your use of or inability to use the website or services.

Our total aggregate liability to you for any claim arising out of or relating to these terms or your use of the website shall not exceed the total amount paid by you to Fortify in the twelve (12) months preceding the event giving rise to liability.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

You agree to defend, indemnify, and hold harmless Fortify Home Services Inc., its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to your use of the website, your violation of these terms, or your violation of any rights of another person or entity.

These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising out of or relating to these terms shall first be addressed through informal resolution by contacting Fortify directly. If the dispute is not resolved within 30 days, the parties agree to submit to non-binding mediation in Toronto, Ontario.

Nothing in these terms limits your rights under the Consumer Protection Act, 2002 (Ontario) or your right to seek recourse through the Ontario Small Claims Court.

You agree that any legal action arising out of or relating to these terms must be brought exclusively in the courts located in Toronto, Ontario, and you consent to the jurisdiction of such courts.

The Fortify Canada website may contain links to third-party websites or services that are not owned or controlled by Fortify Home Services Inc. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

Your use of third-party websites or services is governed by their respective terms and policies. We encourage you to read the terms and privacy policies of any third-party site you visit.

Certain payment processing, hosting, and communication services used by Fortify are provided by third parties. While we select reputable providers, we are not liable for the acts or omissions of these service providers.

We may terminate or suspend your access to the website immediately, without prior notice or liability, for any reason, including if you breach these Terms of Service.

Upon termination, your right to use the website will cease immediately. All provisions of these terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
