Information We Collect

When you enroll in a Fortify Protection Plan or request service, we collect personal information necessary to provide our services. This includes your full name, email address, phone number, service address (street, city, postal code), and details about your home and HVAC equipment.

For billing purposes, we collect payment method information, including credit card or bank account details, which are securely processed through our PCI-compliant payment processor. We do not store complete card numbers on our servers.

We also collect service-related data such as scheduled visit dates, technician notes, maintenance history, and equipment specifications. This information is used exclusively to deliver and improve our HVAC services.

Technical information is collected automatically when you visit our website, including your IP address, browser type, device information, and pages visited. This data helps us improve website functionality and detect potential security issues.

How We Use Your Information

Your personal information is used primarily to administer your Protection Plan, schedule service visits, process payments, and communicate with you about your account. We send service reminders, appointment confirmations, and important plan updates via email or SMS based on your preferences.

We analyze aggregated service data to identify equipment trends, improve technician training, and optimize our service territories. This analysis is performed on anonymized datasets and does not identify individual customers.

With your explicit consent, we may send promotional communications about new services, seasonal maintenance tips, or plan upgrade opportunities. You can opt out of marketing communications at any time by clicking the unsubscribe link in any email or contacting us directly.

We do not sell, rent, or trade your personal information to third parties for marketing purposes under any circumstances.

Information Sharing and Disclosure

Fortify Canada shares your information only with trusted service providers who assist in our operations. These include payment processing services, cloud hosting providers, and SMS/email delivery platforms. All third-party providers are contractually bound to use your data solely for the purpose of delivering services to Fortify and are prohibited from using it for their own purposes.

In the event of a property sale, Premium Shield plan holders may request a transfer of their plan to the new homeowner. With your written consent, we share only the minimum necessary plan information with the new owner and update our records accordingly.

We may disclose your information if required by law, court order, or government regulation, or if necessary to protect our legal rights, investigate fraud, or respond to an emergency threatening personal safety.

If Fortify Canada is involved in a merger, acquisition, or sale of assets, customer information would be transferred as part of that transaction, subject to the same privacy protections outlined in this policy.

Data Security

We implement industry-standard security measures to protect your personal information from unauthorized access, alteration, disclosure, or destruction. All data transmitted between your browser and our servers is encrypted using TLS 1.3 (HTTPS).

Payment information is processed through PCI DSS Level 1 compliant gateways. We do not store full credit card numbers or CVV codes on our infrastructure. Tokenized payment references are used for recurring billing.

Access to customer data within Fortify is restricted to authorized personnel who require it to perform their job duties. All employees with data access undergo background checks and sign confidentiality agreements.

We regularly review and update our security practices, conduct vulnerability assessments, and maintain incident response procedures. Despite these measures, no internet transmission or electronic storage method is completely secure, and we cannot guarantee absolute security.

Data Breach Notification

In the unlikely event of a data breach involving your personal information, Fortify Canada will notify affected individuals and the Office of the Privacy Commissioner of Canada as required by the Personal Information Protection and Electronic Documents Act (PIPEDA).

Notification will be provided without undue delay after becoming aware of the breach, and in any case no later than required by applicable law. Notifications will include a description of the breach, the types of information involved, the steps we have taken to contain the breach, and recommended steps you can take to protect yourself.

If a breach poses a real risk of significant harm to affected individuals, we will also notify relevant provincial privacy commissioners and law enforcement where required by law. We will maintain records of all breaches and our response actions.

Data Retention

We retain your personal information for as long as your Protection Plan is active, plus a reasonable period thereafter to comply with legal obligations, resolve disputes, and enforce our agreements. Typically, customer records are retained for seven (7) years after plan cancellation in accordance with Ontario business record requirements.

Service visit records and equipment history may be retained longer for warranty tracking and quality assurance purposes. Aggregated analytics data is retained indefinitely in anonymized form.

Upon your request, we will delete or anonymize your personal information within 30 days, except where retention is required by law or necessary for legitimate business purposes such as fraud prevention.

Your Rights and Choices

Under the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable Ontario privacy legislation, you have the right to access, correct, update, or delete your personal information held by Fortify Canada.

You have the right to withdraw consent for the collection, use, or disclosure of your personal information, subject to legal or contractual restrictions. Withdrawing consent may result in the termination of your Protection Plan if we are unable to provide services without the information in question.

If you believe your privacy rights have been violated, you may file a complaint with the Privacy Commissioner of Canada or the Information and Privacy Commissioner of Ontario.

Fortify Canada's services are intended for Ontario homeowners aged 18 and older. We do not knowingly collect personal information from individuals under the age of 18. If we become aware that we have inadvertently collected information from a minor, we will promptly delete it.

We may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or service offerings. The updated policy will be posted on this page with a revised effective date.

For material changes that affect how we use or share your information, we will notify you by email or through a prominent notice on our website at least 30 days before the changes take effect. Continued use of our services after the effective date constitutes acceptance of the revised policy.
